Terms of Use
These Terms of Use ("Terms") govern access to and use of the Whisperer service ("Service"). By registering or using the Service you agree to these Terms.
These Terms constitute a public offer within the meaning of Article 437 of the Civil Code of the Russian Federation. Registration with the Service constitutes full and unconditional acceptance of that offer (Article 438 of the Civil Code) and forms a contract on the terms set out below.
1. Service Description
Whisperer is a desktop application and web service that transcribes speech in real time during meetings and delivers AI-powered text hints. The Service is available for macOS and Windows.
2. Age Requirement
The Service is intended for users aged 16 and older. By registering, you confirm you are at least 16 years old. Minors may only use the Service with consent of a legal guardian.
3. Account Registration
You are responsible for maintaining the confidentiality of your login credentials. If you suspect unauthorised access, notify us immediately at support@whisperer.one. Creating accounts on behalf of third parties without their explicit consent is prohibited.
4. Permitted Use
The Service is provided solely for personal and professional use in compliance with applicable law. You may use it during meetings, job interviews, lessons and negotiations in which you are a participant.
5. Prohibited Use
You may not:
- Record, process or transmit conversations of third parties without their knowledge and consent;
- Use the Service for fraud, deceiving employers or educational institutions;
- Automated mass data collection (scraping, crawling);
- Deliberately exhaust the Service's computing resources and the external API and AI-model limits paid for by the Operator: automated or mass generation of requests, artificial inflation of calls, circumvention of quotas and plan limits, as well as any actions whose sole or primary purpose is to increase the Operator's costs or to disrupt the economics of the Service;
- Attempt to circumvent technical restrictions, hack or destabilise the Service;
- Resell access to the Service or its components to third parties.
Such behaviour is detected, among other means, automatically. Upon detecting it, the system may automatically freeze and block (ban) the account without prior notice; no refund is made for the period in which the violation occurred (see the Refund Policy). If you believe the block is mistaken, write to support@whisperer.one for review.
6. Pricing and Payment
Current pricing is available on the pricing page. Payment is accepted through the payment systems indicated during checkout. Refunds are governed by a separate refund policy.
7. Intellectual Property
All rights to the source code, design, trademarks and other Service materials belong to Shakhbanov Zurab Mukhtarovich. You receive a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.
Content generated by you during sessions (transcripts, notes) belongs to you.
8. Privacy
Personal data processing is governed by our Privacy Policy. At registration the user grants Consent to the Processing of Personal Data; receiving marketing communications is governed by a separate Consent to Marketing Communications and is not a condition of using the Service.
9. Disclaimer and Limitation of Liability
The Service is provided "as is" without warranties of accuracy, uninterrupted operation or fitness for a particular purpose. We are not liable for direct or indirect damages arising from use or inability to use the Service, except as required by applicable law.
Our maximum aggregate liability to any single user is limited to the amount actually paid by that user in the preceding 12 months.
10. Suspension and Termination
We may suspend or terminate access for breach of these Terms. You may delete your account at any time via the Settings section of your dashboard.
11. Amendments
We will notify you of material changes by email at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
12. Governing Law
These Terms are governed by the law of the Russian Federation. Disputes shall be resolved in courts of general jurisdiction at the place of business of the sole trader, unless required otherwise by applicable law.
