Consent to Receive Marketing Communications
Pursuant to Article 18 of Russian Federal Law No. 38-FZ of 13 March 2006 “On Advertising”, the User hereby grants Shakhbanov Zurab Mukhtarovich, sole trader (INN 054203786124, OGRNIP 326050000099429, e-mail: support@whisperer.one; the “Controller”), consent to receive advertising and informational messages on the terms set out below.
1. Communication channels
The Controller may send messages to the e-mail address provided by the User at registration or in the profile section of the personal account.
The Controller does not send messages by SMS or make telephone calls.
2. Types of messages covered by this consent
- information about new features and material updates to the Service;
- educational materials, tips on using the Service, event announcements;
- promotions, discounts and special offers on plans and subscriptions;
- surveys and feedback requests.
3. Messages that do not require this consent
Transactional and service messages do not constitute advertising, require no separate consent, and are sent by the Controller in performance of the Terms of Use:
- the e-mail verification code sent at registration;
- password recovery;
- notifications about payment, renewal and expiry of a subscription;
- critical account security notifications;
- notifications of changes to the Terms of Use and the Privacy Policy.
4. Term of consent
This consent is granted for an indefinite term and remains in force until withdrawn by the User.
5. Withdrawal of consent
The User may opt out of marketing communications at any time by one of the following means:
- by clearing the corresponding checkbox in the “Settings” section of the personal account;
- by sending a request to support@whisperer.one.
Once an opt-out is received, the Controller ceases sending advertising messages within a reasonable technical period not exceeding 7 (seven) calendar days.
6. Opting out does not affect the Service
Withdrawal of this consent does not restrict the User’s access to the functionality of the Service, does not affect subscription terms, and does not stop the transactional and service notifications listed in clause 3.
7. Confirmation
By ticking the corresponding box in the registration form or in the account settings, the User confirms that they have read this document and grant consent voluntarily. The marketing communications checkbox is unticked by default — consent is given solely by an affirmative action of the User.
